doordash deliveryA DoorDash class action alleges that drivers for the delivery service don’t receive full tips from consumers who pay through the app, according to a employement lawsuit filed in California.

Plaintiffs Jennifer Peter and Karson Theiss claim that they were misled about the nature of their tips when making purchases from DoorDash.

When a consumer makes a purchase from DoorDash, their delivery driver is reportedly guaranteed a minimum payment. Although consumers are able to leave tips for their drivers, the workers allegedly do not receive these tips on top of their minimum payment. Instead, DoorDash allegedly uses these tips to subsidize their own payments to drivers.

For example, if a driver is guaranteed a minimum payment of $7 and the consumer leaves no tip, DoorDash reportedly uses their own money to pay the driver. However, if the consumer were to leave a $3 tip, this amount would allegedly be used by DoorDash to pay the minimum payment. In this situation, DoorDash would reportedly use the $3 tip and $4 of their own money to pay the driver their guaranteed payment.

“The result is that the Dasher receives no additional compensation by the consumer leaving a tip through DoorDash’s website or app, and the consumer is deceived into leaving a tip that merely reduces the amount that DoorDash has to pay the Dasher to meet the guaranteed minimum payment,” the DoorDash class action lawsuit states.

According to Peter and Theiss’ DoorDash class action, they were not aware that DoorDash would essentially be stealing their tips. They were reportedly led to believe that their tips would be given directly to the driver on top of a minimum guaranteed payment.

DoorDash allegedly fails to inform consumers of their tip policy on their website. Instead, customers are allegedly given an option to add a “Dasher Tip” with no other information about how their tip will be used. According to the DoorDash class action, reasonable consumers assume that their tips will be given to the drivers.

Even if consumers were to go through the extra effort to hunt down information about DoorDash’s tip policy, the website allegedly lacks clear information.

The DoorDash class action claims that “nothing” on the website section informs customers that “their tips are being used by DoorDash to subsidize the Dasher’s guaranteed minimum payment and in most cases provide no financial benefit to the Dasher.”

Peter and Theiss seek to represent a Class of consumers who placed a food delivery order through DoorDash and paid a tip through the website or app. The plaintiffs also seek to represent two subclasses of the same consumers from Missouri or Illinois, respectively.

DoorDash Inc. faces similar allegations in another class action lawsuit filed in Georgia. The plaintiffs in this DoorDash class action also claim that drivers for the delivery company do not receive 100 percent of their tips. Unlike Peter and Theiss, the plaintiffs in this case were drivers and brought claims based on their employment.

    Yo conducía para DoorDash genere más de 3000 Delyvery y desactivaron mi cuenta pero el error de ellos es que mi dinero no lo depositan en mi cuenta y tienen también que rembolsarme y mi teléfono no me deja entrar para hablar con un agente esto es un abuso yo necesito ayuda

    I literally caught a merchant stealing my tip. The restaurant lemonade took a $43 tip for me and which I had to receive that was screenshot to me from the customer proving that they Paid the trip. There’s many ways that we are not getting paid our tips and we need to deserve our money. Thank you.

    I worked for DoorDash from 8/2020 to 1/22. I worked graveyard shift but left because I wasn’t getting any tips at all or very low tips

    Working with Doordash for the past 2017. Deactivated my account for accusing me abusing Doordash platform. I don’t really understand of their allegation and i filed an appeal they stand their final action. Doing the right thing and hard working to earn for living.My goal in life.

    I know they are paying as with our tips from time to time still and not putting up their money to pay as for our time etc doing a delivery ..I’m in Ca.. a delivery will come over and state examr it’s . 5.$8.00 for the delivery ..I’ve pickedd it up delivered and once I got that I did delivery the order to customer all of a sudden.. I made $ q2. Instead of theirbinak $8.00 it’s like they withold money if you don’t deliver ion time or the where delivery did t go in a positive way..Where did that extra $4.00 come from..they might of just gave you the $8.00 and kept part or all of the customers tip..they are still being shady in their ways at door dash..

    I work as a Doordasher in South Jersey. They been doing the same thing to me for the last three years I worked Doordash. They definitely mess with the performance metrics so that it can decrease job availability because you’re not taking bad jobs for unfair fees. I’ve done over 4000 deliveries in those 3 years. They even cheated me on tips. Which if I didn’t report it to them and show screenshots they wouldn’t honor the agreed upon price for delivery. I had to agree to the terms of arbitration clause because otherwise I wouldn’t be able to keep working and wouldn’t have a job through out the whole pandemic but the work conditions never match the pay or distance of some of these jobs. If you are an artist, you depend on these jobs. It’s a shame that the system takes advantage of good people trying to make a livable wage while people try to stay a float managing their own lives. If you want to add me to the list you can but I don’t answer back to weird emails that look like spam.
